By giving us a phone number or email address you consent to receive those communications and to have your data processed by these providers. Message frequency varies. Standard carrier rates apply. You can opt out at any time (SMS: reply STOP; email: use the unsubscribe link).

9.1 Recordings and Transcripts

Calls handled by our AI voice agents may be recorded or transcribed for quality, training, and analytics. By calling or receiving a call you consent to recording and transcription. If your local law requires a recording disclosure, you agree to play or include the legally mandated notice to your callers.

9.2 Client Representations (When We Contact Your Leads)

If you hire SmartCompany AI to reach out to your prospects or customers, you confirm that:

You have obtained each recipient’s prior express written consent—or another legally valid opt‑in—to receive the type of message being sent.

You will keep proof of each consent for at least four years and provide it on request.

The contact lists you supply are accurate, current, and screened against all applicable do‑not‑contact registries.

The content you ask us to send complies with the Telephone Consumer Protection Act (TCPA), CAN‑SPAM Act, CTIA guidelines, A2P 10DLC requirements, and all other relevant laws and carrier rules.

You will honor every opt‑out request immediately. If we receive an opt‑out on your behalf, we will process or forward it and you will not contact that recipient again without a new opt‑in.

We may suspend or terminate messaging services, without refund, if we reasonably believe your contact lists, content, or practices violate these Terms, carrier rules, or any law.

Our AI works with the data you supply. You are responsible for call scripts, knowledge‑base content, and legal compliance. Results vary. We do not guarantee specific business outcomes.

The site and services are provided "as is" and "as available." We make no warranties of any kind, including fitness for a particular purpose or non‑infringement.

13. Limitation of Liability

To the fullest extent allowed by law, our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose. We are not liable for lost profits, lost data, or indirect damages.
